Steve Pejovich (1931-2021) est professeur d'économie à l'Université du Texas. Il a écrit de nombreux ouvrages et articles portant sur le domaine du droit de propriété et sur la théorie de la transition économique. D'origine Yougoslave, son prénom est Svetozar qu'il a américanisé en "Steve", il a fait ses études à Belgrade (LLB) et son doctorat à l'université de Georgetown (USA).

Steve Pejovich se pose la question des incitations institutionnelles adéquates pour la performance économique. Il "micro-analyse" les effets des incitations qui s"opèrent dans les institutions formelles et informelles et sur ​​la façon dont elles se mélangent pour produire des résultats préférés. Steve Pejovich accorde une attention particulière aux différents effets d'incitation qui proviennent de la common law, de l'État de droit et du droit civil.

Il décompose la notion d’État de Droit en quatre composantes principales :

• Les droits de propriété privée,
• Le droit des contrats,
• Un système judiciaire indépendant
• Une constitution.

Steve Pejovich souligne également l'importance de l'individualisme, qui est au cœur de la performance économique. Les droits de propriété privée permettent l'échange volontaire pour produire des richesses, à condition que les contrats soient respectés. L'importance du droit des contrats réside dans la réduction des coûts de transaction. cependant, un droit spécifique des contrats est sans valeur sans un pouvoir judiciaire indépendant qui confirme l'attente des résultats stables.
