Todd J. Zywicki est né en 1966. Il est actuellement professeur de Droit à l'université George Mason où il enseigne sur les sujets des faillites et des contrats depuis 1998. De 2003 à 2004, il fut directeur du Bureau de la planification des politiques à la Federal Trade Commission. Il a également enseigné à la Vanderbilt University Law School, au Georgetown University Law Center, à la Boston College Law School et à la Mississippi College School of Law de 1996 à 1998.

Il a obtenu son premier diplôme en 1988 au Dartmouth College (AB). Il a poursuivi ses études à l'université Clemson (Master en économie) avant de soutenir sa thèse en Droit à l'Université de Virginie. Il a travaillé pour le juge Jerry E. Smith de la Cour d'appel des États-Unis et a collaboré comme associé chez Alston & Bird à Atlanta, en Géorgie, où il pratiquait le droit des faillites et le droit commercial.

Todd Zywicki est l'auteur de plus de 50 articles dans des revues juridiques et économiques. Il est un commentateur fréquent dans les médias imprimés et audiovisuels, ainsi qu'un contributeur régulier du blog "The Volokh Conspiracy". Défenseur des idées libérales, dans une tribune du Wall Street Journal, en décembre 2008, il y a critiqué les propositions pour renflouer l'industrie automobile américaine.
